What is an EEOC Complaint?
An EEOC complaint is a type of complaint that is filed with the United States Equal Employment Opportunity Commission. EEOC complaints are filed by workers who believe they are victims of discrimination in the work place. Common forms of work place discrimination include: pregnancy discrimination, gender discrimination, age discrimination, religious discrimination and race discrimination. According to federal law, employers are prohibited from discriminating against employees due to their age, race, gender, religion or disabilities. Employers are also not allowed to treat employees differently due to personal bias.
After an employee has become a victim of discrimination, he/she may file a complaint with the EEOC in person, on the phone or by mail. Once a complaint has been filed, the EEOC will investigate the discrimination claims. If they find that discrimination has occurred, employers or companies may face legal action.
What is an ACRD Complaint?
While complaints may be filed at the federal level with the U.S. Equal Employment Opportunity Commission, complaints may also be filed at the state level. Employees that reside in the state of Arizona and who have been subjected to discrimination in the work place may file a complaint with the Arizona Civil Rights Division (ACRD). Once an employee has filed a discrimination complaint with the ACRD, the ACRD will begin to investigate accusations by speaking with the employee and employer. Before people decide to file an EEOC complaint or an ACRD complaint, it is always advisable that they review their rights and legal options with a professional employment lawyer, like the lawyers at Gillespie, Shields & Associates.
