What is Employment Discrimination?
Employment discrimination occurs when an employer, company or co-worker is biased toward a person because of the person’s gender, age, religion, ethnicity, sexual orientation or disability. In the United States, there are employment discrimination laws in effect that prevent employers from discriminating in the work environment.
There are several federal and state statutes that prohibit employment discrimination. In fact, the U.S. Constitution and several states’ constitutions protect employees from bias, harassment and discrimination in the work place. When an employer discriminates against an employee, he/she is directly violating both federal and state laws, which may lead to investigations and criminal prosecution in some cases.
When Does Employment Discrimination Occur?
There are several acts or practices that may be indicative of employer discrimination. Some of these acts include:
- not hiring a candidate because of bias
- not promoting an employee because of bias
- not allowing an employee to take on a new job assignment because of bias
- not giving an employee a raise because of bias
- retaliating against an employee due to bias
- wrongful termination of an employee due to bias
- harassing an employee due to bias
Anytime an employee is subjected to unlawful treatment in his/her place of employment and feels that he/she has been discriminated against, the employee may have the right to pursue legal action. The first thing people will want to do once they have become victims of employment discrimination is to secure representation from an experienced attorney who handles employment law cases.
