What is Employment Law?
Employment law, commonly referred to as labor law, is a legal practice area that governs the rights of employees and the responsibilities of employers. These laws outline which employer behaviors are considered illegal by both the state and federal government. Employment law also governs relationships between employees and their employers.
What are Examples of Employment Law Violations?
There are numerous ways in which an employer may violate labor laws. For instance, if an employer decides not to hire a potential employee because the employer is biased toward the person’s age, race, gender or religion, it is a considered discrimination, which is a direct violation of employment law. Another example of an employment law violation would be an employer failing to pay an employee his/her wages or overtime pay.
What Can Employees Do?
If an employee believes that his/her employer has violated employment laws, there are several things he/she can do. First, the employee could speak with his/her company’s human resources department. The employee could file a complaint or a report and allow human resources to deal directly with the issue. In some cases, human resources will take complaints seriously and conduct investigations if necessary. The department will then intervene by putting an end to illegal activities and by attempting to rectify the situation with the employee that filed the complaint.
If this option does not work and illegal activity continues, employees may want to consider reviewing their situations with a knowledgeable lawyer who specifically handles employment law cases, like the lawyers at Gillespie, Shields & Associates.
