What is Gender Discrimination?

Gender discrimination is a type of discrimination that occurs when employers exercise bias toward an employee due to his/her gender or sex.  Like all types of discrimination, gender discrimination falls under the realm of employment and labor law and is prohibited by the Civil Rights Act.  Gender discrimination laws also protect employees from sexual harassment and pregnancy discrimination

When the Civil Rights Act was passed in 1964, all employees were protected from discrimination in the work place.  According to the Civil Rights Act, employers are not allowed to discriminate against an employee because of his/her sex.  Additionally, employers are prohibited from discriminating against employees due to their race, religion, age or medical conditions.  If employers have bias toward an employee because of his/her sex or treat an employee differently because of his/her sex, they are committing gender discrimination.  When this happens, the employee may file a complaint or decide to sue his/her employer for the pain and suffering he/she has incurred.
