What is Pregnancy Discrimination?

Pregnancy discrimination is a type of discrimination that occurs when an employer has bias against a woman for being pregnant.  Due to the bias, the employer may not hire the woman or he/she may fire or demote the woman.  The employer may partake in pregnancy discrimination if he/she fails to give a pregnant woman a raise or discriminates against a woman for taking maternity leave.  Anytime an employer engages in any of these behaviors, he/she is violating discrimination and employment laws and may be subjected to legal action if the pregnant employee chooses to file a claim or civil suit.

Pregnancy Discrimination Act

Years ago, Congress added the Pregnancy Discrimination Act to the Civil Rights Act of 1964.  After this legal change, discrimination against pregnant women in the work place became illegal.  According to the Pregnancy Discrimination Act, employers are strictly forbidden against discrimination against pregnancy, child birth or related medical conditions.  The Act also states that women who are pregnant must be treated the same as other employees or job candidates.  If employers fail to treat pregnant women the same as other employees or candidates, they will violate federal laws.
