What is Religious Discrimination?

Religious discrimination is a type of discrimination that occurs when employers exercise bias toward an employee due to his/her religious preferences.  Anytime an employer’s decisions related to hiring, firing, demoting, raises or job assignments are impacted by his/her religious bias, it is considered religious discrimination.  Religious discrimination falls under the broad legal area of employment discrimination and is illegal according to federal law.

Under the Civil Rights Act of 1964, all employers are strictly prohibited from discriminating against an employee because of his/her religion.  It does not matter if the employee is Christian, Jewish, Muslim or Buddhist.  Employers are prohibited from making decisions based upon an employee’s religious preference, beliefs or practices.  Additionally, employers are not allowed to treat employees differently based upon their religion.

The Civil Rights Act also dictates that employers must make reasonable accommodations when it comes to an employee’s religion, unless accommodations cause the company undue hardship.  For example, if an employee would like time off from work to observe a religious holiday, the employer must grant the employee time off, unless there are extenuating circumstances.
