What is Wrongful Termination?

Wrongful termination, also called wrongful discharge or wrongful dismissal, occurs when an employer unlawfully terminates a person’s employment or violates the person’s employment contract.  For example, if an employee filed a discrimination complaint and the employer decided to retaliate by firing the employee, it may be considered wrongful termination.  Additionally, wrongful termination occurs when an employer terminates a person’s employment due to discrimination against the employee’s gender, age, sexual orientation, ethnicity, religion or disability.
